THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO CONTEMPT CASE No.139 of 2015 ORDER :

Heard the learned counsel for petitioner and Sri G.Narender Reddy, learned Standing Counsel for respondent Nos.1 and 2. 2.

Respondent Nos.1 and 2 are also present in person. 3.

On 20-08-2014 in W.P.M.P.No.29330 of in W.P.No.23415 of 2014, this Court had suspended the cancellation dt.21-02-2014 of the renewal of permission granted to petitioner on 05-10-2013 pending disposal of the Writ Petition on the ground that it was not preceded by any opportunity or notice. 4.

This Contempt Case has been filed stating that notwithstanding the suspension of the cancellation of the renewal notice, on 02-09-2014 another cancellation notice of the said renewal was issued by 2nd respondent.

It is not in dispute that subsequently the proceeding dt.02-09-2014 was withdrawn on 09-04-2015 by issuing letter to the petitioner.

In view of the fact that the petitioner was prevented from making construction in the intervening period of 7 months, an affidavit was filed on 06-04-2017 by 2nd respondent stating that extension of time would be granted to petitioner for a period of 7 months to take up construction.

MSR,J C.C.No.139 of 2015 - 2 - 7.

Today, proceedings Ref.No.GP/09/2017 dt.12-04-2017 issued by the 1st respondent has been produced granting time for a period of 7 months from 12-04-2017 to petitioner to construct additional sheds. 8.

In view of the said proceeding, the Contempt Case is closed. However, the 2nd respondent shall pay costs of Rs.1,000/- (Rupees One Thousand only) to the petitioner.

Miscellaneous applications pending, if any, in this Contempt Case shall stand closed.
