THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26463 of 2016 ORDER:

This Writ Petition is filed challenging the action of the respondents in not paying subsistence allowance to the petitioner as per the service regulations and also not reinstating him into service.

It appears that the petitioner was suspended by the third respondent on 22.01.2016 and no subsistence allowance was paid from that date. It appears that a charge memo was issued on 23.02.2016 and a reading of the same prima facie shows that the petitioner committed misconduct. The enquiry is yet to be completed.

The learned Government Pleader produced before this Court a copy of letter, dated 06.09.2016 addressed to him by the second respondent. A perusal of the same reveals that an amount of Rs.59,439/- was sanctioned towards subsistence allowance to the petitioner.

ARLR, J W.P.No.26463 of 2016 In view of the above, there cannot be any grievance with regard to the payment of subsistence allowance to the petitioner. However, in view of pendency of the enquiry against the petitioner since January, 2016, this Court disposes of the Writ Petition with a direction to the second respondent to complete the enquiry initiated against the petitioner within a period of three months from the date of receipt of a copy of this order. It is needless to observe that till conclusion of such enquiry, the petitioner is entitled to subsistence allowance in accordance with law.

Consequently, Miscellaneous Petitions, if any pending in this Writ Petition shall stand closed. No order as to costs. _____________________________ A.RAMALINGESWARA RAO, J 6th SEPTEMBER, 2016.
