HONOURABLE SRI J USTICE N. BALAYOGI CRIMINAL REVISION CASE No. 2088 OF 2018 ORDER:

Learned Counsel for the petitioners/Accused Nos.2 and 3 seeks permission to withdraw the Criminal Revision Case with liberty to file appropriate application before the trial Court seeking to recall NBWs and to direct the trial Court to consider the same and pass appropriate orders thereon.

Permission is accorded with liberty as sought for. 3.

In the result, the Criminal Revision Case is dismissed as withdrawn with liberty to the petitioners to file appropriate application before the trial Court seeking to recall NBWs issued against them. If such an application is filed, the trial Court is directed to consider the same, on merits and in accordance with law, on the same day itself.
