THE HONOURABLE SRI JUSTICE M.S.K.JAISWAL Criminal Petition No.7146 of 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by the petitioner/accused seeking to quash the C.C.No.1773 of 2010 on the file of the XI Additional Chief Metropolitan Magistrate at Secunderabad, for the offence under Section 138 read with Section 142 of Negotiable Instruments Act, 1881.

Heard the learned counsel for the petitioner/accused and the learned Public Prosecutor and perused the material available on record.

In view of the allegations against the petitioner/accused, this Court is of the view that truth or otherwise of the allegations made against the petitioner can be decided only after due trial. Hence, this Court is not inclined to interfere with the proceedings against the petitioner.

Accordingly, the Criminal Petition is dismissed. Consequently, the miscellaneous petitions pending in this petition, if any, shall stand closed.
