THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.14353 OF 2017 ORDER :

The case of the petitioners is that their respective fathers being brothers were protected tenants of the lands in Sy. No.516 and 514 to an extent of Ac.5-02 guntas and Ac.13-03 guntas, respectively in Turkapally village, Shamirpet mandal, Medchal District, were duly issued with certificate under Section 38 (E) of the Andhra Pradesh (Telangana Area) Tenancy and Agricultural Lands Act, 1950, vide proceedings in No.B/353/LRE/75, dated 27-06-1975 by the Addl. Revenue Divisional Officer (LR), Hyderabad East Division. That the parents of the petitioners died and after their death, the petitioners became absolute owners of the lands in question and inherited the property, being sons.

Grievance of the petitioners is that they made a representation dated 18-01-2017 to the 4th respondentTahasildar, Shamirpet mandal, Medchal District, to mutate their names in the revenue records based on the documents submitted by them, but till today no action has been taken on the said representation. Hence this writ petition.

Heard learned counsel for the petitioners and the learned Asst. Government for Revenue.

Learned counsel for the petitioners submits that earlier the 4th respondent issued notice dated 06-12-2014 and sought to conduct enquiry and for that purpose fixed the date of hearing on 20-12-2014, but no further action has been taken in the matter.

In view of the facts and circumstances of the case, suffice it to direct the 4th respondent to dispose of the representation dated 18-01-2017 said to have been made by the petitioners after issuing notices to the petitioners and the affected parties and after conducting enquiry, as earlier proposed, pass appropriate orders thereon, in accordance with law, within a period of two months from the date of receipt of a copy of this order.

With the above directions, the writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed. _______________________________ A.RAJASHEKER REDDY, J Dated: 25-04-2017 NRG
