THE HONBLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.37031 of 2012 ORDER :

Heard learned counsel for the petitioner, learned Government Pleader for Revenue and learned counsel for respondent No.4. Perused the material available on record.

The present writ petition came to be filed seeking issuance of a writ of mandamus to declare the inaction of the respondents in not passing any orders on the representation dated 14.03.2006 of the petitioner made for fixation of rate for regularisation of his house bearing MCH No.10-5-2/3/3/2, admeasuring 515 sq. yards situated at Masabtank, Hyderabad as illegal and improper and consequently direct the respondents to regularise the house by fixing the rate. Though various grounds are raised in the writ petition, the counsel for the petitioner restricts the prayer seeking a direction to respondent No.1 to consider his representation for regularisation of the property in terms of G.O.Ms.No.166, dated 26.06.2008, which is pending consideration.

Learned Government Pleader for Revenue submits that none of the parties are owners of the property and that it is a Government land. According to him, respondent No.4 filed O.S.No.1310 of 2011 before the IX Junior Civil Judge, City Civil Court, Hyderabad for permanent injunction and the same was dismissed holding that it is a Government land. Therefore, the petitioner is not entitled for any relief as sought for.

A perusal of the record would show that against the orders passed in O.S.No.1310 of 2011 by the IX Junior Civil Judge, Hyderabad, respondent No.4 filed A.S.No.253 of 2014 on the file of IX Additional Chief Judge, City Civil Court, Hyderabad and the same is pending consideration. Since the request of the petitioner is only to consider his representations for regularisation, the Writ Petition is disposed of directing respondent No.1 to dispose of the representations dated 08.02.2006 and 14.03.2006 made by the

petitioner as expeditiously as possible preferable within a period of three months from the date of receipt of a copy of the order, in accordance with law. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
