THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9145 OF 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner who is arrayed as Accused No.10 in the event of his arrest in Crime No.219 of 2022 on the file of Station House Officer, Ibrahimpatnam Police Station, Jagtial District, registered for the offences punishable under Sections 143, 452, 307, 324, 354, 290, 323 and 506(ii) read with Section 149 of Indian Penal Code and Sections 3(1)(r)(s), 3(2)(v) of SC/ST (POA) Act, 1989.

Heard learned counsel for petitioner/Accused No.10 and learned Additional Public Prosecutor for respondent-State. Perused the record.

On perusal of the complaint, on 05.10.2022 it is alleged that two parties fought with each other armed with deadly weapons. This petitioner is shown as Accused No.10 and it is mentioned in the remand report that he belongs to SC Madiga Community.

As seen from the remand report of Accused No.1 and others, there are no specific overtacts attributed to this petitioner in the fight which ensued.

In the said circumstances, for the reason of there being no specific allegations against this petitioner, the prayer for anticipatory bail can be considered.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.10 shall be enlarged on bail in the event of his arrest subject to the following conditions:

i) The petitioner/Accused No.10 is directed to surrender before the Station House Officer, Ibrahimpatnam Police Station, Jagtial District within ten (10) days from today, and on such surrender, he shall be enlarged on bail on his executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties for a like sum each, to its satisfaction.

ii.

On such release, the petitioner/Accused No.10 shall appear before the investigating authorities as and when required for the purpose of investigation.

iii.

The petitioner/Accused No.10 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. Miscellaneous applications, if any, pending shall stand closed. _____________ K.SURENDER, J Date: 28.10.2022 ns
