THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 11201 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused seeking bail in the event of their arrest in connection with Crime No.183 of 2023 on the file of Marikal Police Station, Narayanpet District, registered for the offences under Sections 307, 324, 332, 341, 342, 353, 143, 148, 506 and 120-B r/w. 34 r/w 149 of IPC and Section 4 of PDPP Act, 1984.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The Marikal Police registered the present crime, while villagers, 200 in number, were protesting against a company that was established and producing Ethanol. On 21.01.2023, the said 200 members stopped truck with 40,000 litres of inflammable substance. The Police went there on Bandobasth duty. It is alleged that the Mob had turned unruly resulting in injuries to some of the Police personnel. The names of 14 members were incorporated in the complaint, who have participated in the attack. The names of these petitioners were
not mentioned in the complaint. However, the petitioners are identified as part of the Mob, who attacked the Police. 4.
Keeping in view that there were around 200 persons, who were agitating in the said place, this Court deems it appropriate to grant the relief of anticipatory bail to the petitioners, subject to following conditions:-
1) The petitioners/Accused are directed to surrender before the Station House Officer, Marikal Police Station, Narayanpet District, on or before 22.11.2023. Upon such surrender, the said Station House Officer shall release the petitioners/Accused on bail, on their executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to his satisfaction.
2) On such release, the petitioners/Accused shall appear before the concerned Police between 10:00 a.m. and 1:00 p.m. on every Monday for a period of eight weeks for the purpose of investigation and thereafter, as and when required.
3) The petitioners/Accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
