THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.29788 OF 2017 ORDER:

Petitioner claims that petitioner's father had purchased land admeasuring Acs.4.00 in Survey No.115 at Mailardevpally Village, Rajendranagar Mandal. Revenue records reflect his name in Survey No.115/2/A. After sale of land admeasuring Acs.2.00, an extent of Acs.2.00 of land remained in the possession of the family. In this Writ Petition, initially, the petitioner sought three prayers. However, the petitioner filed WP.MP.No.27367 of 2017 whereunder the petitioner stated that in so far as prayers (a) and (b) are concerned, he would prosecute independently before the appropriate forum and confined his prayer in the Writ Petition only to prayer (c). In prayer (c), the petitioner seeks direction to the respondents to mutate the name of the petitioner in the revenue records and issue pattadar pass book by carrying out survey. Therefore, the Writ Petition is considered only to the extent of relief prayed in prayer (c).

According to the petitioner, an application was made on 28.04.2017 to mutate his name in the revenue records but so far no decision is taken. Ex.P1 is a receipt generated through TS-Online website which discloses filing of application for mutation in revenue records.

Since an application is already made to mutate the petitioner's name in the revenue records and so far the same is not disposed of by the Tahsildar (fourth respondent), the fourth respondent is directed to examine the claim of the petitioner by following due procedure as required in law, if necessary, putting
the petitioner and rival claimants on notice and pass appropriate orders as warranted by law by assigning reasons in support of his decision. Such a decision shall be communicated to the petitioner within a period of two (2) months from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
