THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.34602 of 2016 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed to call for the records pertaining to Crime No.4 of 2015 lodged by the 3rd respondent against the petitioners for the offences punishable under Sections 120-A, 177, 200, 194 to 196, 209, 420 and 468 read with 34 IPC and quash the same and consequently, direct the 2nd respondent not to arrest the petitioners in connection with the aforesaid crime. 2.
Learned counsel for the petitioners submits that without following the procedure as contemplated under Section 195 Cr.P.C., the present complaint is lodged and hence, he prays to set aside the aforesaid crime registered against the petitioners. 3.
Heard the arguments and perused the material available on record.

Considering the facts and circumstances of the case and without going into the merits of the case, this Court is not inclined to interfere with the investigation in the aforesaid crime, but at the same time, the respondent-police are directed to complete the investigation without arresting the petitioners and file Final Report, if any, in accordance with law. The petitioners are also directed to appear before the Investigating Agency as and when required and cooperate with the investigation.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. __________________ RAJA ELANGO, J OCTOBER 24, 2016 YVL
