THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 9146 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A2 in connection with Crime No.657 of 2022 on the file of Chilkalguda Police Station, Gopalpuram Division, for the offences punishable under Section 302 read with 34 of the Indian Penal Code.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record. 3.

The petitioner who is arrayed as Accused No.2 was remanded on 05.09.2022 and according to the Remand Report, Accused No.1 and 3 caused the death of the deceased. A1 and A3 (Juvenile) went inside the house of the deceased and while they committed the murder of the deceased woman, it is alleged that Accused No.2 was standing outside the room to keep a watch.

Except the said allegation of the petitioner keeping a watch outside the room in which A1 and A2 committed acts causing the death of the deceased, there is no other allegations against this petitioner. 5.

For the said reason, this petitioner who is in jail since 05.09.2022 can be granted the relief of regular bail on the following conditions;

i) The petitioner/A2 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of X Additional Chief Metropolitan Magistrate, Secunderabad.

(ii) The petitioner/A2 shall appear before the concerned Station House Officer, on every Monday between 10.30 A.M. to 1.00 P.M. for a period of eight weeks or until filing of charge sheet, whichever is earlier, for the purpose of investigation. iii) The petitioner/A2 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
