THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.11253 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/Accused No.2 seeking anticipatory bail in the event of her arrest in connection with F.I.R No.262 of 2023 dated 04.10.2023 on the file of the Santosh Nagar Police Station, Hyderabad District, registered for the offences punishable under Sections 306 and 498-A of Indian Penal Code (for short 'IPC'). 2.

Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that at the daughter-in-law of the petitioner had committed suicide on account of the unbearable harassment both physically and mentally meted out by the husband and others.

Learned counsel for the petitioner submits that in the complaint, bald allegation is made that this petitioner is also responsible for the harassment meted out by the husband/accused No.1.

Keeping in view that there are bald allegations leveled against this petitioner and also she is aged about 70 years, this Court is inclined to grant the relief of anticipatory bail, subject to the following conditions:

1) The petitioner/Accused No.2 is directed to surrender before the Station House Officer, PS, Santosh Nagar, Hyderabad District within one (1) week. Upon such surrender, the said Station House Officer shall release the petitioner/Accused No.2 on bail, on her executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/Accused No.2 shall appear before the concerned police as and when required for the purpose of investigation.

3) The petitioner/Accused No.2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
