HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CIVIL REVISION PETITION No.4570 OF 2011 ORDER:

The Civil Revision Petition is filed under Section 115 of C.P.C by petitioner/ judgment debtor impugning the docket order passed on 11.08.2011 in E.P. No.52 of 2008 in O.S. No.57 of 2003 on the file of the Senior Civil Judge, Gudivada against respondent/ decree holder.

2) Heard learned counsel for petitioner/ judgment debtor and learned counsel for respondent/ decree holder and perused the material on record.

3) The judgment debtor is granted time to liquidate the entire decree amount with execution costs on or before 06.06.2016 failing which from the undertaking given by waiving all objections and he cannot raise any objection to proceed with the sale of the property. In the meantime, the Executing Court shall stay of all further proceedings in E.P. No.52 of 2008 in O.S. No.57 of 2003 on the file of Senior Civil Judge, Gudivada, by virtue of this order. However, if no payment made fully by 06.06.2016, the Executing Court is at liberty to proceed further.

4) Accordingly, the revision is disposed of. No order as to costs.

5) As a sequel, miscellaneous petitions if any pending in this Civil Revision Petition shall stand closed.
