THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.33705 OF 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The petitioner complains that in spite of filing an appeal along with the stay petition on 28.09.2015 before the Revenue Divisional Officer, Vizianagaram District, the 2nd respondent, the same are not yet taken up for hearing and no orders are passed. The petitioner states that the order, dated 23.09.2015, of the Tahsildar, Garividi Mandal, Vizianagarm District, the 3rd respondent, is questioned in the appeal. The petitioner apprehends that the land in question would be taken over and assigned to third parties.

Since the petitioner has presented the appeal only on 28.09.2015, which is hardly a week back, inaction as alleged is clearly not made out. However, the 2nd respondent is directed to fix an early date for hearing of the said appeal along with the stay petition and pass appropriate orders atleast to the extent of the stay petition, within a period of two weeks from the date of receipt of a copy of this order. The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
