THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WP No.46675 OF 2016 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the 4th respondent in not considering his representation dated 26-02-2016 for allotment of the land under Section 3 (5) of the AP Assigned Lands (Prohibition of Transfers) Act, 1977 by granting exemption and also in putting up a notice board directing the petitioner not to enter the subject land, as being illegal, arbitrary and to pass consequential orders in the interest of justice.

Heard learned counsel for the petitioner and the learned Asst. Government Pleader for Revenue.

Basing on written instructions received in the matter, it is stated by learned Asst. Government Pleader for Revenue that the petitioner is in possession of the subject land and any action initiated against him would be taken by following the due process of law.

Recording the submission made by the learned Asst. Government Pleader for Revenue, the writ petition is disposed of directing the 4th respondent-Tahsildar, not dispossess the petitioner from the subject land, without taking recourse to due process of law.
