THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY TRANSFER CRIMINAL PETITION No. 170 OF 2018 ORDER:

This transfer criminal petition is filed under Section 407 of the Code of Criminal Procedure (for short, 'Cr.P.C.') to withdraw C.C.No. 47 of 2018 on the file of the Court of Additional Judicial I Class Magistrate, Sangareddy (for short, 'the Court below'), and transfer the same to the Court of Additional Chief Metropolitan Magistrate at Miyapur, Ranga Reddy District. 2.

Heard learned counsel for the petitioner.

The petitioner is the accused and the reason assigned by him for transfer of the above C.C. is that respondent No. 1-de facto complainant is a retired Sub Inspector and the latter is threatening him while attending the Court below, for which a report is lodged but no action has been taken so far and that therefore it is difficult for him to attend the Court below on the dates of adjournment to face the trial.

Having regard to the above, if sufficient protection is provided to the petitioner through the Court below, he can appear before it without any fear in his mind. Therefore, I deem it appropriate to direct the Court below to provide necessary protection to the petitioner whenever he appears before it in connection with the above C.C. on his application subject to bearing expenses. 5.

With the above direction, the transfer criminal petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in consequence. _____________________________ Date: 03-08-2018.
