THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.10518 of 2009 ORDER:

This criminal petition is filed under Section 482 of Cr.PC to quash the proceedings in C.C.No.708 of 2007 on the file of the Court of the III Additional Judicial Magistrate of I Class, Kakinada, East Godavari District.

No representation for the petitioner. On 03.03.2016 this Court passed the following order:

"If the learned counsel for the petitioner fails to produce the proof of sending of notice to the second respondent as directed by this Court on 24.10.2014, the Criminal Petition stands dismissed automatically."

In spite of the above conditional order, the petitioner did not choose to file proof of sending of notice to the second respondent. No purpose will be served in keeping the matter. Hence the Criminal Petition is dismissed. Consequently, miscellaneous petitions, if any pending in the criminal petition, shall stand closed. __________________________ T.SUNIL CHOWDARY, J.
