THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 9147 of 2022 O R D E R:

This Criminal Petition is filed under Section 438 of the Code of Criminal procedure, 1973 seeking pre-arrest bail to the petitioner who is arrayed as Accused No.1 in the event of her arrest in Crime No.217 of 2022 on the file of Station House Officer, Devarakonda Police Station, Nalgonda District for the offence punishable under Section 306 of Indian Penal Code.

Heard learned counsel for the petitioner/Accused No.1 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

A complaint was filed against this petitioner alleging that the petitioner had participated in sexual intercourse with the deceased. The petitioner was involved in prostitution and the petitioner along with another woman harassed the deceased sexually, for which reason, the son of the de facto complainant committed suicide by consuming poison.

The aforesaid allegation made against this petitioner is on the basis of the assumption. As seen from the complaint, learned Assistant Public Prosecutor has not produced any evidence to substantiate the relation between the deceased and this petitioner. In the said circumstances, this petitioner can be granted the relief of anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.1 shall be enlarged on bail in the event of her arrest subject to the following conditions:

i) The petitioner/Accused No.1 is directed to surrender before the Station House Officer, Devarakonda Police Station, Nalgonda District, within ten (10) days from today, and on such surrender, she shall be enlarged on bail on her executing personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties to the like sum each, to its satisfaction.

ii) On such release, the petitioner/Accused No.1 shall appear before the investigating authorities as and when required for the purpose of investigation.

iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.
