HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.322 of 2016 ORDER:

This petition is filed to transfer H.M.O.P.No.151 of 2015 from the file of Senior Civil Judge, Sattenapally, Guntur District, to Senior Civil Judge, Kothagudem, Khammam District,

2. Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 20.08.2014 at Dwaraka Thirumala Temple, West Godavari District as per Hindu rites and custom and she was forcibly left at her parents' house on 19.11.2015 and now she is staying at Bhadrachalam as a destitute lady. She stated that she is feeling insecurity to attend the Court at Sattenapally and as there are threats from respondent she prayed for transfer of H.M.O.P. from Sattenapally to Kothagudem.

3. Respondent did not file any counter.

4. Heard both sides.

5. Advocate for petitioner submitted that a crime was registered for the offence under Section 498-A IPC at Bhadrachalam Police Station, therefore, by taking convenience of wife, her request for transfer may be considered.

He further submitted distance between Sattenapally and Bhadrachalm is more than 200 km.

6. Advocate for respondent submitted that respondent is an employee in State Bank and it is difficult for him to

travel from Sattenapally to Kothagudem as it is not directly connected and any middle place may be considered for the convenience of both parties.

7. Considering the submissions of both parties, I deem it appropriate Khammam may be convenient place for both parties, where Family Court is located.

8. For these reasons, H.M.O.P.No.151 of 2015 is withdrawn from Senior Civil Judge, Sattenapally, and transferred to Family Court, Khammam, for disposal in accordance with law.

9. Transfer C.M.P. is ordered accordingly.

10. Miscellaneous petitions pending, if any, shall stand closed.
