THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO TRANSFER CRIMINAL PETITION NO.22 of 2015 ORDER:
Upon hearing the learned counsel for petitioner at the admission stage, the petition is ordered as follows:
The request of the learned counsel for petitioner to transfer C.C.No.38 of 2014 on the file of Judicial First Class Magistrate at Thorrur cannot be considered as there are no grounds. But, having regard to the submission of learned counsel for petitioner that the petitioner apprehends harm in the hands of second respondent when he attends the Court on each occasion, in the interest of justice, the personal appearance of petitioner/accused in C.C.No.38 of 2014 on the file of Judicial First Class Magistrate, Thorrur, is hereby dispensed with except on the occasions when the said Court requires his attendance in the Court. The trial Court is directed to dispose of the above said C.C. No.38 of 2014 at the earliest.
As a sequel, miscellaneous petitions, if any, pending shall stand closed.
