THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13021 of 2024 ORDER:

This Criminal Petition is filed under section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of prearrest bail to the petitioner who is arrayed as accused No.2 in Crime No.1097 of 2024 of Kukatpally Police Station, Cyberabad Commissionerate.

The brief facts of the case are that the petitioner, along with other accused, are running an Institute named "International Institute of Aviation", which gives training for the candidates aspiring employment in Aviation sector. The said Institute has given an assurance of 100% placement on completion of course by paying Rs.80,000/-. It is the allegation that the de facto complainant has completed the said course but could not get any placement, and thus, was cheated by the accused. It is further alleged that subsequently, the accused have changed the name of the Institute as "Go Top Edutech Pvt. Ltd." by duping the former students and to cheat some more innocent students.

Heard Sri Kodamagundla Ravi Kumar, learned counsel appearing on behalf of the petitioner as well as Sri Syed Yasar Manoon, learned Additional Public Prosecutor appearing on behalf of the respondent No.1-State.

Learned counsel for the petitioner submitted that the petitioner is not in any way related to the International Institute of Aviation Pvt. Ltd., in which, the de facto complainant has pursued the Aviation course by paying Rs.80,000/-. It is submitted that one Sumeet Suseelan and Smiley Sood were having 60% and 40% shares respectively in the said institute. Hence, as the petitioner is not running the institute, he has prayed for grant of anticipatory bail to the petitioner.

On the other hand, learned Additional Public Prosecutor submitted that the accused persons in the present crime have cheated the innocent students by collecting huge amounts for Aviation course with an assurance of 100% placement, and that the matter is under investigation. Accordingly, he prayed to dismiss the petition.

On perusal of the material placed on record, it is apparent that in the complaint, though allegations are made

against three persons including the petitioner, the record prima facie discloses that the institute in question is owned and being run by one Sumeet Suseelan and Smiley Sood, who are having 100% shares in it who were already granted bail. Therefore, this Court is of the considered view that it is a fit case for grant of anticipatory bail to the petitioner. 7.

Accordingly, this petition is allowed granting anticipatory bail to the petitioner subject to the following conditions:

i.

The petitioner shall surrender before the Station House Officer of P.S.

Kukatpally, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.20,000/- with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the

Investigating Officer in investigating the case.

Miscellaneous applications, if any pending, shall stand closed.
