THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CIVIL REVISION PETITION No. 3921 of 2015 ORDER:

The petitioners are plaintiff Nos. 1 and 3 in O.S.No.350 of 2003 on the file of Principal Junior Civil Judge, Nuzvid. The said suit was filed by them along with 4th respondent herein for a declaration of title and for perpetual injunction in respect of Ac.0.54 cents of land situated in Korlakunta Village, Musunuru Mandal, Krishna District. The evidence was let in by both the parties and at the stage of arguments, the plaintiffs filed I.A.No.263 of 2013 seeking impleadment of 3rd defendant in the suit and for making consequential amendments.

A counter was filed by the defendants resisting the said application.

The trial Court dismissed the said application by observing that at the stage of arguments and after seeking several adjournments, the said application was filed. The Order of the trial Court dt. 28.07.2015 is perfectly valid as it could be seen that the present suit is filed in the year 2003 and the plaintiffs had properly impleaded the original defendant Nos. 1 and 2 and they have also let in evidence. In these circumstances, this Court sees no reason to interfere with the finding of the trial Court dt.28.07.2015 in I.A.No.263 of 2013 in O.S.No.350 of 2003.

Accordingly, this Civil Revision Petition is dismissed. There shall be no order as to costs. As a sequel, miscellaneous petitions, if any, pending in this case, shall stand closed.
