THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Second Appeal No.1039 of 2007 JUDGMENT:

This Second Appeal under Section 100 of the Code of Civil Procedure, 1908 arise out of judgment dated 01.05.2007 passed by the learned Senior Civil Judge, Kovvur in A.S.No.8 of 2002 wherein the learned Senior Civil Judge had confirmed the decree and judgment dated 29.01.2002 in O.S.No.4 of 1997 passed by the learned Principal Junior Civil Judge, Kovvur.

When the appeal is taken up for hearing, learned counsel for the appellant/plaintiff had submitted that the parties had settled the matter out of court and therefore, he is not pressing the appeal. Recording the said submission, this second appeal is dismissed as not pressed. There shall be no order as to costs. Miscellaneous petitions, pending if any, in this appeal shall stand closed.
