THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40926 OF 2014 ORDER:

The writ petition is filed seeking a writ of mandamus declaring the action of the respondents in opening and continuing the rowdy sheet vide Rowdy Sheet No.112 of 2014 against the petitioner as illegal and arbitrary, and consequently to quash the same.

Heard and perused the material.

Learned counsel for the petitioner submits that the petitioner was falsely implicated in criminal cases and that some of the cases were withdrawn and in some of them, the petitioner was acquitted. He further submits that from the year 2013 onwards, there are no cases pending against the petitioner, and as such, he prays this Court to direct the respondents to close the rowdy sheet against the petitioner.

Considering the facts and circumstances of the case, the petitioner is directed to make a representation to the respondents 3 and 4 stating that he is not involved in any crimes from 2013 onwards and on filing of such application, the respondents 3 and 4 are directed to consider the representation and pass appropriate orders as expeditiously as possible, preferably within a period of two months from the date of application of the petitioner. Further, the respondents 3 and 4 are directed not to compel the petitioner to come to the Police Station.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 02.01.2017 pln
