THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9181 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C."), seeking to enlarge the petitioner/accused No.6 on bail in connection with Crime No.488 of 2022 of Cyber Crime Police Station, Cyberabad District, registered for the offences punishable under Sections 420, 467, 468, 120(B)(2) of the Indian Penal Code, Section 27(2) of Arms Act and Section 66 (C) & (D) of Information Technology Act. 2.

Heard learned counsel for the petitioner/accused No.6 and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The Cyber Crime Police station, Cyberabad, registered the present case on the allegation that accused Nos.1 and 2 have taken money from the de facto complainant promising to provide dealership of KIA Motors in favour of the de facto complainant. Accused Nos.1 and 2 have sent mails and also interacted with the de facto complainant regarding grant of dealership.

The case against the petitioner/accused No.6 is that she was one of the telecallers, who called the de facto complainant regarding the transactions.

Even according to the Remand Report the petitioner was a telecaller, called the de facto complaint on behalf of accused Nos.1 and 2. Assuming that this petitioner had knowledge about any illegality that was committed by accused Nos.1 and 2, she was arrested by the Police.

Since the petitioner/accused No.6 was arrested and in jail, this Court is inclined to grant the relief of regular bail to the petitioner/accused No.6 on the following conditions: i) The petitioner/accused No.6 is directed to be released on bail on her executing personal bond for Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each, among them one surety shall be local and one surety shall be native, to the satisfaction of the learned IX Additional Metropolitan Magistrate, Cyberabad, at Kukatpally.

ii) The petitioner/accused No.6 shall appear before the Station House Officer, Cyber Crime Police Station, Cyberabad, on every Monday between 09.00 A.M. to 04.00 P.M., for a period of six weeks, thereafter as and when required. iii) The petitioner/accused No.6 shall comply with the conditions as laid down under Section 437 (3) of Cr.P.C. 7.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
