THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 44378 of 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

With the consent of both the parties, the Writ Petition is disposed of at the admission stage.

The present Writ Petition came to be filed questioning the notice dated 08.12.2016 wherein and whereunder the petitioner was directed to appear before the Tahsildar-respondent No.3 along with necessary documents showing his right over the land in respect of alleged passage dispute.

Learned counsel for the petitioner submits that the petitioner is the owner of the land and in view of the pendency of civil dispute between the parties, the authority has no right to interfere with the property in dispute.

Learned Government Pleader for Revenue would submit that since only a notice has been issued to him, the petitioner can as well explain all the circumstances to the Tahsildar, who shall consider the same, in accordance with law.

Having regard to the above submissions made, the writ petition is disposed of directing the petitioner to submit his explanation within a period of two weeks from today, in which event, the authorities shall consider the same, in accordance with law, after hearing the petitioner and all the aggrieved persons, if any. Till such time, the

Tahsildar-respondent No.3 shall not interfere with the property in dispute.
