HON'BLE Dr. JUSTICE CHILLAKUR SUMALATHA CRIMINAL APPEAL No.1331 of 2010 ORDER:

Aggrieved by the Judgment dated 26.07.2010 passed in Crl.A.No.27 of 2010, on the file of the Court of Principal Sessions Judge, Khammam, the present Criminal Appeal is filed before this Court.

Learned counsel on record for the appellant has informed the Court that he had given up vakalat. This Court therefore directed the Registry to send notice to the appellant. The letter addressed by the Principal District & Sessions Judge, Khammam, to the Registrar (Judicial) is on record which reveals that the notice sent could not be served on the appellant as the appellant was not residing in the given address. The certificate issued by the Divisional Corporator, Municipal Corporation, is also on record to the same effect.

Though the matter is listed under the caption 'For Dismissal' on this day, yet, there is no representation on appellant's side.

Hence, the Criminal Appeal is dismissed for nonprosecution. 5.

Miscellaneous petitions, if any pending, shall stand closed.
