THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9217 OF 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner who is arrayed as Accused No.1 in the event of her arrest in Crime No.191 of 2022 on the file of Station House Officer, Charminar Police Station, Charminar, registered for the offence punishable under Section 365 read with Section 34 of Indian Penal Code. 2.

Heard learned counsel for petitioner/Accused No.1 and learned Additional Public Prosecutor for respondent-State. Perused the record.

Briefly the case of the prosecution is that the 1st wife of the victim lodged a complaint stating that he has dropped her in the High Court and thereafter he went missing. When investigated it was found that this petitioner who is the 2nd wife of the victim had sent Accused Nos.2 and 3 to get the victim to her house. When the victim went to this petitioner's house, he said that he will return in 10 minutes and left the home. Basing on the complaint, the police

registered the crime against this petitioner and two others for the aforesaid offence.

Even according to the prosecution, this petitioner is the 2nd wife of the victim/LW2, for the said reason, this petitioner can be granted the relief of anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.1 shall be enlarged on bail in the event of her arrest subject to the following conditions:

i) The petitioner/Accused No.1 is directed to surrender before the Station House Officer, Charminar Police Station, Charminar within ten (10) days from today, and on such surrender, she shall be enlarged on bail on her executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties for a like sum each, to its satisfaction.

ii.

On such release, the petitioner/Accused No.1 shall appear before the investigating authorities as and when required for the purpose of investigation.

iii.

The petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.
