2016-01-07Sanjay Kumar1 pages

THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 895 of 2016 ORDER:

The petitioner is aggrieved by the proceedings dated 19.12.2015 passed by the Prohibition and Excise Superintendent, Mahabubnagar, whereby his TFT licence was suspended with immediate effect pending further enquiry.

2. Perusal of the impugned proceedings reflects that the subject suspension was effected by the excise authorities as a precautionary and temporary measure to prevent the supply and sale of toddy by the petitioner pending enquiry into the possibility of any adulteration by him.

3. In that view of the matter, this Court is not inclined to interfere with the impugned proceedings.

4. As the petitioner's livelihood is at stake, the writ petition is disposed of directing the Prohibition and Excise Superintendent, Mahabubnagar, to complete the enquiry expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
