HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.6627 of 2017 ORDER:

Heard learned counsel for the petitioners/A.1 to A.3 and also learned Public Prosecutor representing the State and before ordering notice to the 2nd respondent-defacto complainant of crime No.47 of 2017 of Ramagiri Police Station, Peddapally District, registered for the offences under Sections 306 IPC r/w 34 IPC, which is pending investigation and perused the grounds urged and also legal position and scope of Section 306 IPC and the contents of the complaint show the Amin/Bailiff went for executing the orders of the Court.

So far as the investigation concerned, it is premature for this Court to indirect, but for to say there is prima facie no ground to arrest pending investigation.

Having regard to the above, the Criminal Petition itself is disposed of with a direction to conduct the investigation, but not to arrest the petitioners pending investigation, unless there is any necessity to move the Court if at all to consider on own merits.
