Heard.

The petitioner questions the order of resumption passed by the 4th respondent in Proceedings Ref.No.B/333/2011, dated 20-10-2011, on the ground that there was no notice to her and she has received the impugned order only after taking up proceedings under the Right to Information Act. Thus, the impugned order was given to her only on 24-11-2015. As the petitioner was not available in the place and as such she could not be served notice and that she obtained the said order under the Right to Information Act. Even then, the petitioner can always prefer an appeal by mentioning the aforesaid ground that the order was furnished to her only on 24-11-2015 and make all her submissions before the appellate authority. Since a regular appeal lies against the order of resumption, there is no reason to entertain the writ petition, particularly as the impugned order is passed as far back as 20-10-2011.

Hence, with a liberty to the petitioner to approach appellate authority, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed. _______________________ VILAS V.AFZULPURKAR, J Date: 08-12-2015 Prv
