HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.30294 of 2010 ORDER:
There is no representation on behalf of the petitioners. The prayer sought in the writ petition is as under: "... to issue an appropriate writ, order or order direction more particularly one in the nature of writ of Mandamus declaring the inaction of the respondent No.1 in not taking any stern action against the respondents 2 to 8 in connection with Crime No.127/2009 of P.S. Bibinagar, Nalgonda District as well as not investigating into the crime and not submitting final report before the concerned Additional Judicial First Class Magistrate, Bhongiri, Nalgonda District as illegal, arbitrary and against the principles of natural justice and violation of Articles 14, 16 and 21 of the Constitution of India. Consequently, direct the 1st respondent to submit final report to the concerned Magistrate in the aforesaid crime."
Learned Government Pleader for Home brought to the notice of this Court that pursuant to the registration of Crime No.127 of 2009, investigation was completed and a final report was filed before the Additional Judicial First Class Magistrate, Bhongiri, Nalgonda on 29.06.2010 referring it as "false case". If the petitioners have any objection, the remedy available to them is by way of protest application before the same Magistrate. In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be closed.
Accordingly, the writ petition is closed. No order as to costs. Miscellaneous petitions, if any, shall also stand closed. _____________________ P. KESHAVA RAO, J Date: 05.11.2019.
