THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.21855 of 2017 ORDER:

The petitioner complains inaction in disposing of application No.MU021601061524, dated 16-11-2016 as illegal and unconstitutional. The Assistant Government Pleader, on instructions, submits that the application is pending with the 3rd respondent as on date. The reason for not taking up the application is that a suit in respect of the same subject matter is pending and, therefore, the matter is not proceeded with.

The objection is merely noted to enable the 3rd respondent to understand that once an application is received for mutating the name in the revenue record under the A.P.Rights in Land and Pattadar Pass Books Act, 1971 (for short 'the Act'), the 3rd respondent is under obligation to consider the application and pass orders warranting in the facts and circumstances of the case.

Keeping the application pending is not in line with the scope of the Act. The Assistant Government Pleader submits that the application will be considered and disposed of within one month from the date of receipt of a copy of this order.

By placing the above statement on record, the writ petition is disposed of accordingly. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed. { ______________ S. V. BHATT, J Dt: 05-07-2017 Prv
