CVNR, J & TR, J CCCA 274/2007 JUDGMENT: (per the Hon'ble Sri Justice C.V. Nagarjuna Reddy) At the interlocutory stage, this appeal is taken up for hearing and disposal.
This appeal is filed against judgment and decree dt.2.4.2007 in O.S. No.417 of 2004 on the file of the III Additional Chief Judge, City Civil Court, Hyderabad.
Mr. Srinivas Chitturu, learned counsel for respondent Nos.1 to 3, submitted that respondent Nos.4 to 6 who purchased the suit schedule property from the appellant filed C.C.C.A. No.285 of 2007 against the same judgment out of which the present appeal arises and that they entered into settlement with respondent Nos.1 to 3/plaintiffs in pursuance of which they withdrew C.C.C.A. No.285 of 2007. The learned counsel has placed before the Court a computer generated copy of judgment dt.27.06.2014 by which C.C.C.A. No.285 of 2007 was dismissed as withdrawn.
In view of the above, this appeal is dismissed as infructuous. It is, however, made clear that impleaded respondent No.7 is left free to avail remedies available to him in law for enforcement of his right over any part of the suit schedule property.
As a sequel to dismissal of the appeal, interim order dt.04.10.2007 passed in CCCA MP No.736 of 2007 shall stand vacated and the said application shall stand disposed of as infructuous. __________________________ C.V. NAGARJUNA REDDY, J _________________________ T. RAJANI, J 26-04-2017 bnr
