Heard learned counsel for the petitioner and learned Government pleader for Women and Child Welfare Department. 2.
Petitioner is working as mini Anganwadi worker in Vanapalli Village consequent to the appointment made on 04.03.2013. In the present writ petition, petitioner challenges the proposal to appoint the 6th respondent as Anganwadi worker.

It is not in dispute that the vacancy occupied by the petitioner is reserved to be filled up by the Scheduled Tribe category. Petitioner belongs to Scheduled caste category. The notification is issued calling for applications and in pursuant to it, the selection process is set in motion.

A reading of the order of appointment of the petitioner itself would show that it is a temporary appointment and would continue till regular recruitment is made. The regular recruitment process is now set in motion. At this stage learned counsel for the petitioner sought to contend that the 6th respondent is ineligible to compete to the post reserved for scheduled tribe category as she is found to be not having relevant certificate declaring her as belonging to the Scheduled tribe.

The Court is not inclined to go into those issues. As no appointment order is made, it cannot be assumed at this stage that without verifying the eligibility of 6th respondent, she would be appointed. Thus, the cause in the writ petition is pre-mature.

Accordingly, the Writ Petition is dismissed leaving it open to the petitioner to work out her remedies as available in law, as and when the cause of action arises. Pending miscellaneous petitions, if any, shall stand closed.
