THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.8995 OF 2015 ORDER:
The writ petition is filed seeking a writ of mandamus declaring the action of the third respondent in not taking action on the complaint, dated 04.04.2014 given by the fourth respondent and the complaint dated 10.06.2014 given by the fifth respondent as illegal and arbitrary, and consequently, to direct the third respondent to register the crime against the respondents 6 to 12 and investigate the same. Heard and perused the material.
Learned counsel for the petitioner submits that the third respondent is not registering the case against the respondents 6 to 12 in spite of the complaints, dated 04.04.2014 and 10.06.2014 by the fourth and fifth respondents. Hence, the learned counsel prays this Court to direct the third respondent to register the case against the respondents 6 to 12 and to investigate the crime. Considering the facts and circumstances of the case, the writ petition is disposed of with a direction to the third respondent to register the complaints of the fourth and fifth respondents against the respondents 6 to 12, if it discloses any cognizable offence, and conduct effective investigation and file final report, if any, in accordance with law.
