THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE GUDI SEVA SHYAM PRASAD WRI T PETI TI ON No.9769 of 2016 ORDER: (per SK,J) This writ petition was filed assailing the action of the State Bank of India in proceeding with the sale of the properties belonging to the petitioners under sale notice dated 22.02.2016 without considering their request to credit the balance amount into their respective accounts from out of the sale proceeds after closure of the loan account. It is now represented by Sri Podila Hari Prasad, learned counsel for the first respondent bank, that the sale notice dated 22.02.2016 did not materialise in an actual sale for want of bidders. That being so, we are of the opinion that the cause in this writ petition no longer survives for consideration on merits. The writ petition is accordingly dismissed as infructuous leaving it open to the petitioners to avail appropriate remedies in accordance with law as and when a fresh cause of action arises. Interim order 19.04.2016 shall stand vacated.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
