THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.35166 OF 2015 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
In view of the limited grievance of the petitioner and the order proposed to be passed, no notice need to be issued to respondents 4 and 5.
The petitioner states that he has filed O.S.No.17 of 2014 which is pending before the Additional District Judge, Vikarabad, Ranga District, for partition against defendants 2 to 4, who are his brothers. The petitioner further states that one of his brothers filed proceedings before the Tahsildar, Shankarapally Mandal, Ranga Reddy District, the 3rd respondent, in File No.B/70/2015, which is stated to be contested by the petitioner. In the said proceedings, the brother of the petitioner is stated to have filed sworn statements of himself and another witness and written arguments. The petitioner wants certified copies thereof from the 3rd respondent and on his request, the 3rd respondent issued the impugned proceedings, dated 09.10.
2015, wherein xerox copies of all the documents were furnished to the petitioner and it was stated that during the pendency of the case certified copies cannot be given. Aggrieved by the refusal of issuance of the certified copies, the present Writ Petition is filed. Prima facie, there is no impediment for the 3rd respondent in giving certified copies as sought for by the petitioner, as there is no prohibition under the Rules to give such certified copies.
reason to stay the said proceedings as sought in the interim application filed by the petitioner.
However, learned Government Pleader for Revenue states that the petitioner would be furnished necessary certified copies in due course.
In view of the same, the Writ Petition is disposed of directing the 3rd respondent to furnish the certified copies of the aforesaid documents as sought for by the petitioner, preferably within a period of two weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
