THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.11210 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.1 to in Crime.No.190 of 2023 on the file of Shabad Police Station, Cyberabad, registered for the offences under Sections 120(B), 302 and 201 r/w. 34 of IPC.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that the deceased was having an affair with A-1 initially and thereafter A-1 refused to continue the said relation. However, the deceased was following her and forcing her to continue the relation. Vexed with the attitude of the deceased, a complaint was lodged against the deceased, which was registered as Crime No.275 of 2022 for the offences under Sections 354, 354(A), 354(D) and 506 of IPC.

Unable to bear the harassment and torture of the deceased, all the petitioners conspired and caused death of the deceased. The deceased was assaulted on the night of 01.09.2023 and after

his death, he was put in a sack along with the boulder and threw him in the water to cause disappearance.

According to the remand report, the case is circumstantial in nature and the circumstances clearly indicate that all these petitioners have conspired to kill the deceased. 6.

The petitioners were arrested on 07.09.2023 and are in jail since then.

As seen from the remand report, major part of the investigation is complete, as such, this Court deems it appropriate to grant the relief of regular bail, subject to following conditions:- i) The petitioners/Accused Nos.1 to 7 shall execute personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, for a like sum each to the satisfaction of the Metropolitan Magistrate at Chevella, Ranga Reddy District.

ii) The petitioners/Accused Nos.1 to 7 after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday for a period of eight weeks for the purpose of investigation and thereafter, as and when required.

(iii) The petitioners/Accused Nos.1 to 7 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
