HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.18017 of 2015 ORDER:

This writ petition is highly belated and stale as the petitioner seeks enquiry and mutation of her name in the revenue records in respect of the land admeasuring 8 acres in Sy.No.35 situated at Dasnapur Village, Adilabad Mandal and District at this stage, while her father is stated to have been died as early as on 30-05-1964. The petitioner also made an allegation that some unknown persons have created fake File No.B/182/1956, dated 21-08-1957 and claimed to be the owners of the land in question. Evidently, after a gap of 50 years, the petitioner made an application to the 3rd respondent under Ex.P-1 dated 06-08-2014 requesting for issuance of pattadar passbook in respect of the aforesaid land. The affidavit does not explain, muchless satisfactorily, any reason as to why the petitioner kept quiet from 1964 till now.

The affidavit also does not state the basis for the allegation that the file, referred to above, itself is fake. Moreover, none of the private persons, who are stated to be claiming right over the land, are made parties to the writ petition. Hence, the stale claim by the petitioner, after long lapse of time, appears to be only a speculative claim made to claim the properties at this distance of time. No case is, therefore, made out to exercise discretion in favour of the petitioner.
