THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE GUDI SEVA SHYAM PRASAD WRI T PETI TI ON No.4828 of 2017 ORDER: (per SK,J) The petitioners assail the order dated 28.12.2016 passed by the Debts Recovery Tribunal, Hyderabad, in I.A.No.2817 of 2016 in S.A.No.182 of 2016. The said I.A. was filed by them to call for the original loan documents executed by them in the year 2011 along with the alleged original loan renewal documents executed in the year 2013 from the custody of the State Bank of India. They also sought examination of these documents by forensic experts for an opinion as to the signatures, thumb impressions, age of ink etc. on the ground that the latter set of documents were never executed by them. By the order under challenge, the Tribunal dismissed the I.A.

Sri S.Ravi, learned senior counsel appearing for Sri Ch.Pushyam Kiran, learned counsel for the petitioners, would state that his clients are interested only in the production of the originals of the aforestated documents and that they are no longer desirous of subjecting the same to any forensic examination.

Sri Ambadipudi Satyanarayana, learned counsel for the respondent bank, would submit that the originals of the documents were already produced before the Tribunal and in the event they are required, they would again be produced.

This being the situation obtaining as on today, there is no dispute that remains between the parties on this issue calling for resolution in this writ petition.

The writ petition is accordingly closed recording the submission of Sri Ambadipudi Satyanarayana, learned counsel, that the State Bank of India would produce the originals of the documents in question as and when required by the Tribunal.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
