O R D E R
The grievance of the petitioner is that the Secunderabad Cantonment Board, the respondent herein, is not passing orders permitting her to undertake construction of a compound wall in her property bearing Plot Nos.1 and 2 in Sy.No.194/1 of Gandhinagar, Trimulgherry, Secunderabd Cantonment. The petitioner claims to have made an application in this regard which was received under Inward No.192
dated 20.08.2013.
Sri Sajja Sriram Suryam, learned standing counsel appearing for the respondent Board, however informed this Court upon obtaining instructions that the Board had received two applications with regard to the very same property seeking permission to undertake construction of compound walls. That is stated to be the reason why the matter has been kept pending.
This Court is of the opinion that the respondent Board necessarily has to pass an order upon the application one way or the other. If it is unable to grant permission, it must accordingly inform the applicant of the same along with the reasons therefor. The writ petition is therefore disposed of directing the respondent Board to consider the application filed by the petitioner seeking permission to construct a compound wall, which was received by it under Inward No.192 dated 20.08.2013, and pass appropriate orders thereon in accordance with law. This exercise shall be completed within one week from the date of receipt of a copy of this order. Pending miscellaneous petitions shall stand closed in the light of this final order. No order as to costs.
