HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.C.M.P Nos.690 & 773 of 2014 COMMON ORDER:

These two transfer petitions are filed seeking transfer of A.S.No.98 of 2014 from I Additional District Judge, Guntur to this court to be heard along with A.S.No.454 of 2014 pending before this court.

2. One Ambati Janardhan filed O.S.No.279 of 2013 for partition of plaint schedule properties before Senior Civil Judge, Sattenapalli and Mandala Siva Kasi Ratna Prameela Rani and another filed O.S No.275 of 2013 (old No.165 of 2010) for permanent injunction and these two suits were tried together and a common judgment is passed on 01.05.2014 decreeing partition suit and dismissing the injunction suit. Aggrieved by the dismissal of injunction suit plaintiffs in O.S.No.275 of 2013 preferred A.S.No.98 of 2014 pending on the file of I Additional District Judge, Guntur and defendants in O.S.No.279 of 2013 preferred A.S No.454 of 2014 against the partition decree granted against them. Now both the parties filed separate transfer petitions seeking the same relief of transfer of A.S No.98 of 2014 from Additional District court, Guntur to this court to be heard along with A.S.No.454 of 2014 to avoid conflicting decisions.

3. Both advocates who filed these two transfer

petitions reported that A.S. pending before I Additional District Judge, Guntur has to be withdrawn and transferred to this Court.

4. Considering the submissions of both sides, A.S No.98 of 2014 is withdrawn from the file of I Additional District Judge, Guntur and transferred to this court to be heard along with A.S No.454 of 2014.

5. Accordingly, both Transfer Civil Miscellaneous Petitions are ordered. No costs. Miscellaneous petitions, if any filed in this petition, shall stand closed. __________________ S. RAVI KUMAR, J Date: 07-04-2016.
