This Criminal Petition is filed by the petitioner/A-2 under section 438 of Cr.P.C., seeking for grant of anticipatory bail in Crime No. 140 of 2018 of Duvvada Police Station, Visakhapatnam district, registered for the offences punishable under section 420, 428, 368, 376 read with section 34 of I.P.C.
2. Heard Sri K. Sarva Bhouma Rao, learned counsel representing Sri Naumene Suraparaju Karlapalem, learned for the petitioner/A-2 and the learned Public Prosecutor for the respondent/State.
3. The case of the prosecution is that this petitioner along with others, administered some drinks to the victim and after consuming the same, she went into reeling sensation and later they took her to a photo studio and from there to Sub-Registrar's Office, where she was married to A-1.
4. The counsel for the petitioner submits that all the other accused are at large. But the facts are such that the petitioner does not deserve to be granted anticipatory bail. He can surrender himself before the court concerned and seek regular bail. The lower court shall consider the application filed by the petitioner
seeking regular bail on the same day, subject to the pressure of other work.
5. In the result, the Criminal Petition is dismissed.
6. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand closed.
