HON'BLE SRI JUSTICE S.V.BHATT W.P.No.33443 OF 2015 ORDER:
The assertion of petitioners is not denied by the Revenue Divisional Officer/ 3rd respondent in his written instructions dated 04.11.2015. On the other hand, the instructions refer to a few proposals pending with the department and that these proposals have not been finalized. As the possession of petitioners is not disputed and also the fact that the subject matter of the writ petition is an assigned land, it is open to the respondents, if circumstances warrant, to dispossess the petitioners by following the procedure stipulated by law.
The writ petition is disposed of. There shall be no order as to costs.
Consequently, miscellaneous petitions, if any pending, stand closed.
