HON'BLE SRI JUSTICE SURESH KUMAR KAIT & HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No. 27452 of 2018 O R D E R:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) This writ petition is filed challenging the order dated 25.07.2018 in C.P.No. 34/ 2018 in O.A.No. 208/ 2018, whereby the learned Central Administrative Tribunal, Hyderabad Bench, Hyderabad, while issuing notice in C.P., directed appearance of the 3rd respondent, the 2nd petitioner herein, before the Tribunal on 16.08.2018.

The learned counsel for the petitioners submits that the learned Tribunal, by order dated 08.03.2018, granted interim stay, and thereafter, the petitioners filed M.A.No. 233 of 2018 seeking to vacate the interim stay, but the learned Tribunal, instead of passing an order in the application for stay, issued notice in the Contempt Petition and directed the 2nd petitioner to appear before the Tribunal on 06.08.2018. Since the vacate stay petition filed by the petitioners is pending before the Tribunal, we hereby set aside the appearance of the 2nd petitioner and direct the Tribunal to decide vacate stay petition in M.A.No. 233 of 2018 by passing necessary orders.

Accordingly, the writ petition is partly allowed. No order as to costs.
