THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.410 of 2015 ORDER:

1. This Criminal Petition is filed by the petitioner aggrieved by the order dated 19.12.2014 passed in M.P.No.121 of 2014 in O.P.No.1212 of 2013 by the Additional Family Court, Visakhapatnam.

2. The 2nd respondent, who is the wife of the petitioner, filed the above O.P. on her behalf and on behalf of her children-respondent Nos.3 and 4 against the petitioner claiming maintenance. During the pendency of the O.P., the 2nd respondent filed the above M.P. claiming interim maintenance at the rate of Rs.7,000/- per month to her and Rs.3,000/- per month to each of her children besides legal expenses. The trial Court allowed the above M.P granting interim maintenance at the rate of Rs.4,000/- per month to the 2nd respondent and Rs.2,000/- per month to each of her children viz., respondents No.3 and 4. Aggrieved by the same, the petitioner filed this petition.

3. Heard and perused the material available on record.

4. The present petition is filed in the year 2015 against the interim order passed by the trial Court. No interim order was passed by this Court earlier. Considering the facts and circumstances of the case and in view of the pendency of the O.P., this Court is inclined to pass the following order:

The trial Court is directed to dispose of the above O.P. within a period of three months from the date of receipt of a copy of this order.

5. Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions pending, if any, shall stand closed. _____________________
