This writ petition is filed challenging the cancellation of provisional selection of the petitioner to the post of SCTPC (Civil/AR) vide proceedings dated 28-07-2017 on the ground that the petitioner provided false information as having HMV/HTV driving licence though he is having LMV licence.
Learned counsel for the petitioner submits that when showcause notice was issued to the petitioner on 08-05-2017, the petitioner filed explanation stating that he is having only LMV licence and that he has enclosed LMV licence and a copy of the same is also filed along with writ petition. Learned counsel also says that the petitioner never mentioned that he is possessing as HMV Transport Licence.
On the other hand, learned Assistant Government Pleader for Services says that in the application filed by the petitioner, it is shown as Transport Vehicle Licence HTV/HMV.
It is to be seen that the application filed by the petitioner in pursuance to the notification filed at Page No.25 of the material papers goes to show that it is mentioned as Transport Vehicle licence (HTV/HMV). But the petitioner counsel stated that while typing as Transport Vehicle, software automatically shows as HTV/HMV. It goes to show that the respondents have not considered the explanation of the petitioner and passed the impugned order cancelling the provisional selection. When it is specific case of the petitioner that he possessed LMV licence only and he filed a copy of
the same along with application, but that aspect was not considered by the respondent-authorities.
In view of the same, the impugned order is set aside insofar as the petitioner is concerned and the respondent-authorities are directed to consider the case of the petitioner for appointment in accordance with rules.
Accordingly, the writ petition is allowed to the extent indicated above. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 03-10-2017 Nvl
