THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.11223 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.6 in S.C.No.8 of 2023 on the file of Sessions Judge, Mulugu, registered for the offences under Sections 302 and 120b r/w 34 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

It is the case of the prosecution that A-6, A-8, A-11 and A-12 murdered the deceased. A-11 hit the deceased's car and when he got down, A-1 approached him and stabbed him. A-8 and A-11 dragged the deceased to nearby bushes and stabbed him to death. This petitioner and A-12 confined the complainant and aided A-8 and A-11 in murdering the deceased. 4.

This Court by order dated 06.11.2023 granted the relief of regular bail to A-12. According to the prosecution A-12 and A-6 restrained the complainant in the car. Since this petitioner/A-6 stands on the same footing as A-12 and the reasons mentioned in

Crl.P.No.7083 of 2023, this petitioner can be granted the relief of regular bail, subject to following conditions:- i) The petitioner/Accused No.6 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum each to the satisfaction of the Judicial Magistrate of First Class, Mulugu. The sureties are directed to submit their two latest passport size photographs at the time of furnishing solvency. One such photograph is ordered to be pasted in the surety register against the name of the surety. The other photograph shall be kept in the case record concerned.

ii) The petitioner/Accused No.6 shall remain at his respective District till conclusion of the trial proceedings. He shall appear before the Court concerned on every date of hearing till completion of trial proceedings. (iii) The petitioner/Accused No.6 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 5.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
