Counsel for the Petitioner: Mr. Ch.Ganesh Counsel for the respondent: GP for Services-II The Court made the following:
CVNR, J & GSP, J CC.No.2133 of 2018 Dt:31.08.2018 ORDER: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Contempt Case is filed alleging disobedience of order, dated 02.8.2017, in W.P.No.6688 of 2017.
Learned Government Pleader for Services-II (Telangana) placed before us G.O.Ms.No.78, Panchayat Raj and Rural Development (Pts.IV) Department, dated 28.8.2018, whereunder the services of the petitioner have been regularized as Sweeper along with some other Part-time/Full time Sweepers.
Mr. Ch.Ganesh, learned counsel for the petitioner, submitted that as per the finding rendered by the Andhra Pradesh Administrative Tribunal, Hyderabad (for short 'the Tribunal), the petitioner was a Fulltime Sweeper and that in the afore-mentioned G.O., he is shown as Part-time Sweeper. However, realizing that the said aspect does not fall within the scope of this Contempt Case, he requested for liberty to the petitioner to avail appropriate legal remedies for redressal of his grievance.
In light of the fact that the petitioner's services have been regularized as a Sweeper, the respondents are not liable for being proceeded against in this contempt.
The Contempt Case is, accordingly, disposed of with liberty to the petitioner in terms of the prayer made.
